It's never easy losing someone close to us. Often, the only comforting thing is knowing that the person died of natural causes, or that their suffering from a long-term illness has ended.
Dealing with loss becomes significantly harder when someone leaves this life before their time. And this tragic loss can become amplified if the death is caused by an intentional act or the carelessness of another. What do you do in the midst of loss, when someone you love is taken due to another person’s careless actions?
The legal professionals at Ball Morse Lowe are not only qualified and experienced in wrongful death cases, they are also compassionate and thoughtful. They will take the time to understand your unique circumstance with empathy and care. Our attorneys take an intentional, unique and emotional approach to understanding your situation. Our trusted Oklahoma City wrongful death lawyers will be respectful of your family’s time of grief, while also working tirelessly and aggressively to secure the compensation you deserve.
There are two types of damages that you can pursue in a wrongful death case in the state of Oklahoma. First, you can sue for the damages incurred by the deceased that he or she could have pursued in a personal injury case. These include damages for:
Secondly, a family may sue for damages that represent the burdens they suffer with as a result of losing a loved one. This may involve compensation for grief and loss of companionship, as well as the financial harm resulting from the loss of their loved on whom they depended on.
Oklahoma Statutes Title 12, Section 1053 defines a wrongful death as an incident “when the death of one is caused by the wrongful act of another.” Wrongful act refers to someone’s reckless, negligent, or even intentional act that led to the individual’s death. A wrongful death case is not the same as a criminal case for murder; if the defendant is also tried for murder, the wrongful death case will remain separate. This ensures that even if the individual is found “not guilty” in the criminal court; the victim’s family can still recover compensation for their loss.
Oklahoma legislation permits the “personal representative” of the departed person’s estate to submit a wrongful death claim to court. The personal representative both represents the deceased and also the beneficiaries or heirs of the deceased. This person can be appointed according to the deceased’s will or estate plan or can be appointed by the court. This is the person who will be eligible to file a wrongful death claim.

I cannot thank Karen Pearson and her team enough for all the support they've shown me throughout my unfortunate divorce. With all the twists and turns thrown at my situation both in my personal life, but also my military career. This team always made me feel as though my case took priority. I will forever be grateful for them and highly recommend either of them to represent you as you drudge through your specific situation. Thank you again to Ball Morse Lowe team for everything you did on my behalf.
Ball Morse Lowe, PLLC offer exceptional knowledge in the oil and gas industry among many other things. I have worked with Senior Attorney, Chris Michael, multiple times and he continues to exceed expectations. If you are looking for a group of hard working, time efficient, diligent, and ethical attorneys, Ball Morse Lowe, PLLC and specifically Chris Michael would be a great choice.
I felt like I mattered. I felt like what I had to say was important. Glenn was thoughtful, encouraging and understanding. She helped me navigate the process and validated my thoughts about things I was not sure. Thank you Glenn!!! It was great working with you!
I turned to Ball Morse Lowe PLCC when I needed my mother's estate probated in Oklahoma. It involved mineral rights and I live in California and my mother had not lived in OK for over 60 years. I wanted a firm that would do this correctly and be reasonable in cost. Brian Hill was a pleasure to work with. He and his staff were professional, knowledgeable, friendly and helpful. They made the experience of probate painless, explained things as we went along, and were clear in their expectation of what they would need from me to move the process forward. I am so glad I found them and appreciate deeply all they accomplished on my behalf.
